General Terms and Conditions (AGB)

Provider: WildPort, Owner (Inhaberin): Zixuan Zhao

1. Scope of Application and Provider

(1) These General Terms and Conditions (hereinafter referred to as "Terms and Conditions") apply to all purchase contracts concluded between WildPort, Owner: Zixuan Zhao (hereinafter referred to as "Seller"), and the customer (hereinafter referred to as "Buyer").

(2) The offers are directed at both consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.

2. Conclusion of Contract

(1) The advertisements placed by the Seller on Kleinanzeigen do not constitute a binding offer, but rather an invitation to the Buyer to submit a purchase offer.

(2) The Buyer can submit a purchase offer via message, or by using the "Sicher bezahlen" (Secure Payment) or "Angebot machen" (Make an Offer) functions.

(3) The purchase contract is concluded when the Seller expressly confirms this offer via message or accepts the Buyer's payment.

3. Prices and Payment Conditions

(1) All stated prices are final prices including statutory value-added tax (VAT).

(2) Any additionally incurred shipping costs will be explicitly stated in the respective advertisement.

(3) The payment methods agreed upon during the ordering process or via message are available to the Buyer (e.g., PayPal, bank transfer, cash payment upon collection).

4. Delivery and Shipping

(1) Delivery shall be made to the address provided by the Buyer.

(2) Unless stated otherwise in the advertisement, the delivery time is approximately 3–6 business days after receipt of payment.

(3) If the Buyer acts as a consumer, the Seller bears the shipping risk. If the Buyer is an entrepreneur, the risk passes to the Buyer as soon as the goods have been handed over to the transport company.

5. Right of Cancellation for Consumers

Consumers are entitled to a statutory 14-day right of cancellation. The detailed cancellation policy and the model cancellation form are stored in the provider's profile and will be provided to the Buyer again in text form upon conclusion of the contract.

6. Retention of Title

The delivered goods remain the property of the Seller, Zixuan Zhao (WildPort), until full payment of the purchase price has been made.

7. Warranty and Liability

(1) The statutory warranty rights shall apply.

(2) The Seller is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.

8. Final Provisions

(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
